The ESPN/Nationwide 2014 Mustang Giveaway ("Sweepstakes") is open to legal residents of the fifty (50) United States and the District of Columbia (excluding New Hampshire), who are eighteen (18) years of age or older, or the age of majority in their state of residence, whichever is older, at the time of entry. Employees, officers, directors, agents and representatives of ESPN Internet Ventures ("Sponsor"), Nationwide Mutual Insurance Company ("Presenter"), Project Support Team, Inc. ("P/S/T" and/or "Administrator"), Ford Motor Company and each of their respective parent companies, subsidiaries, affiliates, advertising/promotion/fulfillment agencies, anyone else connected with the production and distribution of this Sweepstakes (hereafter "Released Parties") and their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in their same household, whether or not related, or employees of the Ford Motor Company are not eligible to enter or win. Sweepstakes is void in New Hampshire and where prohibited by law. To enter the Sweepstakes, entrant must be a member of ESPN.com or one of our family of sites (e.g., ABC.com, ABCNEWS.com, Disney Online Family.com). Registration is free. If entrant is not a member, entrant may register by clicking on the link as indicated on the Sweepstakes entry page and following the instructions. During registration, entrant will be asked to provide his or her name, physical address, zip code, telephone number, email address, birth date, gender, to select a user name and password and accept the Terms of Use on ESPN.com. Those who are already members of ESPN.com will be asked to enter their account information (email address or user name, and password) to enter. Entrant may then be asked: (i) to answer survey questions or (ii) to consent to receive promotional emails from the Sponsor and/or Presenter (and/or Presenter's dealers or affiliates) and to having Sponsor share entrant’s personal information with Presenter for such promotional purposes. Answering survey questions or consenting to receive promotional emails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes or to win a prize, nor does answering survey questions or consenting to receive promotional emails increase an entrant's chances of winning. If Entrants consent to receiving promotional emails from Presenter Entrants personal information will be subject to Nationwide's Privacy Policy located at http://www.nationwide.com/other/privacy.jsp. As a member, entrant may enter the Sweepstakes by logging in to the system with entrant's current username and password. Entrants are responsible for insuring that all contact information is up-to-date and accurate.
Consumers will be eligible to participate between 12:00 PM Eastern Time ("ET") on 2/20/14 and 11:59PM ET on 5/4/14 (the "Promotion Period") when they visit www.ESPN.com/Nationwide, complete the member sign-in, and fully complete and submit the online entry form in accordance with the instructions provided to receive one (1) entry. There is a limit of one (1) entry per person/household/email address per day. Additional entries from any person, household or email address in excess of the stated limitation will be void. Entrants must fully complete and submit all non-optional information requested on the online entry form to be eligible. Incomplete and inaccurate entries are void. The name of the "authorized account holder" associated with any given e-mail address will be deemed to be the entrant and must comply with these Official Rules. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, an online service provider, or another organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Proof (to Sponsor's satisfaction) of being the authorized account holder may be required by Sponsor.
Released Parties are not responsible for lost, incomplete, late, damaged, inaccurate, incomplete, misdirected, delayed, stolen, garbled or undelivered entries, or transmissions, failures or malfunctions of phones, phone lines or telephone systems; any error, omission, interruption, defect or delay in any transmission, processing, or communication; interrupted or unavailable network, cable, satellite, Internet Service Provider (ISP), wireless, server or other connections including those through and/or by www.espn.com; miscommunications, failed computer hardware or software or technical failures; lost, non-delivery; misdirected, blocked, or delayed email notifications; garbled, misrouted or scrambled transmissions; printing, typographical or other errors appearing within these Official Rules, in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, telephone, electronic, mail or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries and/or the announcement of the prize. The use of script, macro, automated entry, mechanical or similar devices or any other devices that subvert the entry process to participate is prohibited and all entries through such devices are void. By entering this Sweepstakes, each entrant gives his/her express permission to be contacted by the Sponsor and/or Administrator by email, telephone, overnight delivery and/or mail for Sweepstakes purposes only.
The potential Grand Prize winner will be selected in a random drawing conducted on or about 5/7/14 from among all eligible entries received by 11:59M ET on 5/4/14. The results of the random drawing will be final and binding in all matters relating to this Sweepstakes. Winner will be notified by email, telephone, overnight delivery and/or mail. Odds of winning will depend on the total number of eligible entries received.
One (1) Grand Prize: A 2014 Ford Mustang GT Coupe. Approximate Retail Value ("ARV"): $30,000. The 2014 Ford Mustang GT Coupe ARV is based on 2014 MSRP of a base model. Grand Prize winner is responsible for vehicle registration, license, title and insurance fees and for all costs associated with any available upgrade/option packages and any other expenses related to the acceptance and use of the prize not specified herein. Winner must take delivery of Grand Prize vehicle within 60 days of notice of availability from the Ford dealership near winner's residence designated by Presenter in Presenter's sole discretion, or the Grand Prize vehicle will be forfeited. Grand Prize winner shall be required to personally accept delivery of the vehicle at the designated dealership and present adequate personal identification. Released Parties are not responsible for delays in delivery of the vehicle. Grand Prize winner will be required to provide proof of possessing a valid U.S. automobile driver's license in good standing as well as appropriate automobile motor vehicle insurance prior to the vehicle being awarded. If the Grand Prize winner fails to provide such proof of possessing a valid automobile driver's license and/or appropriate automobile motor vehicle insurance within five (5) days of prize notification, the Grand Prize will be forfeited and the prize may be awarded to an alternate winner. Grand Prize winner shall bear all risk of loss or damage to his/her vehicle after he/she has taken delivery of vehicle. Exact model, color, and options of vehicle and exact vehicle to be awarded are at the sole discretion of Sponsor and subject to availability from manufacturer. EXCEPT AS STATED IN THE MANUFACTURER'S LIMITED WARRANTY FOR THE VEHICLE, THE RELEASED PARTIES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OR ENJOYMENT OF THE VEHICLE, INCLUDING, WITHOUT LIMITATION, THEIR QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Vehicle pictured in any advertising surrounding this Promotion may not be the actual vehicle awarded. All prize details are at Sponsor's sole discretion.
Winner is responsible for federal, state and local taxes, as well as any other costs and expenses associated with acceptance and use of the prize not specified as covered as part of the prize herein. No transfer, assignment, cash redemption or substitution of a prize except by Sponsor due to prize unavailability and then for a prize of equal or greater value as determined by Sponsor. Non-compliance with any of the foregoing may result in disqualification and awarding of the prize to an alternate winner. Potential Grand Prize winner will be required to execute and return an Affidavit of Eligibility, Liability Release and (where permissible) Publicity Release within seven (7) days of date of issuance of notification. Non-compliance with any of the foregoing or these Official Rules, the inability to contact the potential winner as set forth in the winner selection section above, or failure to return such documents within the specified time period may result in disqualification and, time permitting, awarding of the prize to an alternate winner, at Administrator’s sole discretion, from among all remaining eligible entries. By participating, entrants agree to be bound by these Official Rules and agree that: 1) Released Parties and their designees may use (unless prohibited by law) their name, voice, city/state of residence, photograph and/or likeness for advertising and/or trade and/or for any other purpose in any media or format now or hereafter known without further compensation, permission or notification, and 2) Released Parties and their designees and assigns shall have no liability and will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize (including use of the Grand Prize vehicle) or participation in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to modify, suspend or terminate this Sweepstakes (or any portion thereof) should virus, bugs, non-authorized human intervention or other causes beyond the reasonable control of Sponsor, including but not limited to war or armed conflict (whether or not officially declared), labor controversy or threat thereof, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Sweepstakes and, in the event of termination or suspension, at its discretion, select a winner from among all eligible, non-suspect entries received as of the date of the event requiring such termination or suspension.
Sponsor reserves the right to conduct a background check of any and all records of the Grand Prize winner, including without limitation, civil and criminal court records and police reports. To the extent necessary under law, Grand Prize winner shall authorize this background check. Sponsor may also take all steps necessary to corroborate any information provided to Sponsor by Grand Prize winner in his/her interview. In that regard, Grand Prize winner will be obligated to provide necessary contacts and information so that Sponsor may conduct such investigation. Sponsor reserves the right (at its sole discretion) to disqualify the Grand Prize winner from any prize element, based on the background check.
It is the sole responsibility of the entrant to notify Sponsor if his or her e-mail address changes. To do so, click on the help link at the bottom of any ESPN.com page, then click on the Change Personal Information link and follow the instructions.
Except where prohibited, each entrant agrees that: (i) all issues and questions concerning these Official Rules shall be governed by New York law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Sweepstakes or any prize awarded shall be (A) resolved individually, without resort to any form of class action; and (B) filed only in the state or federal courts situated in New York County, New York state, i.e., Manhattan, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (iv) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Personally identifiable information that is submitted by entrants as part of this Sweepstakes will be used to administer the Sweepstakes, select & announce the prize winner and fulfill the prize, and will be treated in accordance with Sponsor's privacy policy, accessible on its website at http://disneyprivacycenter.com/.
